Welcome to Overcomepmos.com.

We are pleased you’re here and appreciate you taking the time to familiarise yourself with our Terms and Conditions.

Our website offers educational resources, online programmes and group coaching designed to support you in learning about your health and wellbeing.

These Terms and Conditions explain what you can expect from us and what we ask of you when using our website, purchasing our programmes or participating in our community.

Overcomepmos.com is owned and operated by Naomi Kivisalu, trading as Overcome PMOS Naturally (ABN 79 856 423 791), based in Queensland, Australia.

Please read these Terms carefully before purchasing or participating in our programmes. By purchasing a programme or accepting these Terms during enrolment, you agree to the conditions relevant to that purchase.

1. Definitions and Interpretation

For the purposes of these Terms and Conditions:

Website means https://overcomepmos.com.

We, Us and Our refer to Naomi Kivisalu, trading as Overcome PMOS Naturally.

You and Your refer to anyone accessing our website or using our services.

Programmes means the online courses, educational resources, group coaching and other services offered through our website.

Content means any text, images, videos, audio recordings, documents, educational materials or other resources provided through our website or programmes.

User Content means any information, comments, images, messages or other materials you choose to submit or share through our website or associated community platforms.

Agreement means these Terms and Conditions together with any applicable programme-specific terms and policies.

Headings are included for convenience and do not affect the interpretation of these Terms.

2. Eligibility

Our programmes and services are intended for individuals aged 18 years and over.

By purchasing or enrolling in a programme, you confirm that you are at least 18 years old and legally able to enter into an agreement.

We reserve the right to decline or restrict access where eligibility requirements have not been met, subject to applicable law.

3. Registration and Account Information

Some programmes may require you to create an account or register through an online platform.

When registering, you agree to provide accurate and up-to-date information.

You are responsible for keeping your account details and passwords secure and for notifying us if you become aware of unauthorised access.

Your account and programme access are intended for your personal use only and must not be shared, transferred or sold to another person without our written permission.

If information provided during registration is materially inaccurate or misleading, we may take reasonable steps to address the matter, including restricting access where appropriate.

4. Payment

When purchasing a programme, you agree to pay the price displayed at the time of purchase.

Payments are processed through the payment methods available at checkout.

Prices, applicable taxes and any payment arrangements will be displayed or explained before you complete your purchase.

We may offer payment in full or through an installment plan, depending on the programme.

An installment plan is a way of paying the agreed purchase price over time. It is not a subscription, and choosing to pay in installments does not automatically remove your obligation to complete the agreed payments.

If a payment is unsuccessful, we may contact you to arrange payment or temporarily restrict programme access, where permitted by law and the applicable purchase terms.

Any applicable currency conversion or bank fees charged by your payment provider are your responsibility.

5. Refund Policy

We encourage you to carefully review the programme description, inclusions and pricing before making a purchase to ensure it is the right choice for you.

All purchases are final, and we do not offer refunds for change of mind.

This includes circumstances where you decide not to participate, do not complete the programme, or your personal circumstances change after purchase.

If you choose to pay through an installment plan, you remain responsible for completing the agreed payments. An installment plan is not a subscription and cannot be cancelled simply because you decide to stop participating.

Your Consumer Rights

Nothing in this Refund Policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable consumer protection laws.

Where a refund or other remedy is required by law, we will honour those obligations.

If you have any questions or concerns about your purchase, please contact us at support@overcomepmos.com

6. Your Responsibilities

We ask that you use our website, programmes and community respectfully and lawfully.

You agree to provide accurate information when requested, respect the rights and privacy of others, and use our materials for their intended educational purposes.

You are responsible for your own participation, decisions and actions arising from the information provided through our programmes.

You agree not to use our website or services in a way that interferes with the experience, safety or rights of other users.

If you access our website from outside Australia, you are also responsible for complying with applicable local laws.

We encourage you to be mindful of the personal information you share in community discussions. Please avoid posting private contact details, financial information or other sensitive information that you would not want other members to see.

We may remove inappropriate content or restrict access where reasonably necessary to protect our website, programmes or community.

8. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our services, business practices or legal obligations.

The updated version will be published on our website with a revised date.

Where changes materially affect an existing purchase or programme, we will take reasonable steps to notify affected customers and respect their applicable contractual and consumer rights.

10. Intellectual Property

The content on our website and within our programmes is protected by copyright and other intellectual property laws.

Unless otherwise stated, the materials are owned by or licensed to Overcome PMOS Naturally.

When you purchase a programme, you receive a limited, personal, non-exclusive and non-transferable right to access and use the materials for your own educational purposes during the applicable access period.

You must not reproduce, distribute, publish, sell, share, modify or commercially exploit our programme materials without prior written permission.

This includes sharing course videos, worksheets, recordings, downloads, login details or other resources with anyone who has not purchased or been authorised to access the programme.

All rights not expressly granted remain reserved.

11. Indemnity

To the extent permitted by law, you agree to be responsible for reasonable losses, costs or claims arising from your unlawful conduct, infringement of another person’s rights or material breach of these Terms.

This provision does not require you to compensate us for losses caused by our own negligence, wrongdoing or breach of applicable law.

12. Suspension or Termination of Access

We may suspend or terminate access to our website, programmes or community where there is a material breach of these Terms, unlawful activity, serious misconduct or a genuine risk to the safety or privacy of others.

Where reasonable and appropriate, we may first provide notice and an opportunity to address the issue.

If your access is restricted or terminated, your rights to refunds or other remedies under applicable consumer laws will continue to apply.

Restrictions relating to intellectual property, confidentiality and other obligations that reasonably need to continue may remain in effect after access ends.

13. Disclaimers and Website Information

The information provided on our website, in our programmes and through our community is intended for general educational and informational purposes only. It is not a substitute for personalised medical advice, diagnosis or treatment.

While we make reasonable efforts to provide accurate and up-to-date information, some content may reflect emerging research, different professional perspectives or information that changes over time.

Our educational content does not take into account your individual medical history, health conditions or personal circumstances.

We encourage you to consult an appropriately qualified healthcare professional before making decisions about your health, including changes to medication, supplements, treatment or lifestyle.

Please do not discontinue prescribed medication or treatment, or delay seeking medical care, based solely on information provided through our website or programmes.

We do not guarantee specific health outcomes or results, as every individual’s circumstances and experiences are different.

We make reasonable efforts to keep our website and its content accurate, current and accessible. However, we cannot guarantee that our website will always be available, uninterrupted or free from technical errors.

14. Limitation of Liability

To the extent permitted by law, we are not responsible for losses arising from circumstances outside our reasonable control, including interruptions to third-party platforms or internet services.

We are also not responsible for decisions made solely in reliance on general educational information without appropriate professional advice.

Any limitation of liability in these Terms applies only to the extent permitted by law and does not exclude liability that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Queensland, Australia.

Subject to any applicable consumer rights or mandatory legal requirements, disputes relating to these Terms may be brought before courts with jurisdiction in Queensland, Australia.

16. Dispute Resolution

If you have a concern about your purchase, programme access or experience with our services, please contact us first at support@overcomepmos.com.

We welcome the opportunity to understand your concerns and work towards a fair resolution.

If we are unable to resolve a dispute directly, either party may seek assistance through an appropriate dispute resolution service or pursue any remedies available under applicable law.

Nothing in this section prevents you from exercising your legal rights.

17. Website and Platform Security

You agree not to interfere with the security or operation of our website or associated platforms.

This includes attempting to access restricted areas without permission, introducing malicious software, interfering with other users’ access or using automated tools in a way that disrupts our services.

We may take reasonable steps to investigate suspected security breaches and protect our website and users.

18. Privacy

Group Coaching and Community Privacy

Some programmes include live group coaching and access to a private online community.

We ask all participants to respect the privacy of others and keep personal or sensitive information shared within group sessions and the community confidential.

You must not record, screenshot, copy or distribute another participant’s personal information or private group discussions without appropriate permission.

Our live group coaching sessions are recorded, and replays may be made available to eligible members within our private community.

We provide notice of recordings and obtain consent where required by law. Because other participants may be present, please share only what you feel comfortable sharing in a group setting.

Although we encourage confidentiality and respectful participation, we cannot guarantee the actions of other members.

We reserve the right to address behaviour that compromises the privacy, safety or wellbeing of other participants.

19. Notices and Communications

We may communicate with you electronically, including by email or through notices published on our website or programme platforms.

Please ensure that your contact information remains accurate so that you can receive important updates relating to your purchases and programme access.

Electronic communications will be provided in accordance with applicable legal requirements.

20. Third-Party Websites, Products and Services

Our website and programmes may contain links to third-party websites, resources, products or services.

These are provided for your convenience, and we encourage you to review the relevant terms, policies and product information before making a purchase.

We do not control the content, availability or privacy practices of third-party websites or platforms.

From time to time, we may recommend products, resources or services provided by third parties, including supplements and other health-related products.

In some circumstances, we may receive a commission or referral fee if you make a purchase through our links.

Any purchase you make with a third-party provider is a separate transaction between you and that provider. Questions about their products, orders, delivery or refunds should generally be directed to that provider.

Any recommendations we make are for general information only and are not a substitute for individual professional health or medical advice.

Where third-party platforms are used to deliver our programmes, their own terms may also apply.

Nothing in this section excludes any legal responsibility we may have under applicable law.

21. No Waiver

If we do not immediately enforce a particular provision of these Terms, this does not mean that we have permanently waived our right to enforce it in the future.

Any waiver must be considered in accordance with applicable law.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as severed to the extent necessary.

The remaining provisions will continue to apply where legally permitted.

23. Assignment

You may not transfer your programme access or rights under these Terms to another person without our written permission.

We may transfer our rights or obligations in connection with a legitimate business transfer or restructuring, subject to applicable law and your existing contractual and consumer rights.

24. Events Beyond Our Control

We understand that unexpected circumstances can sometimes affect the delivery of online services.

We will not be responsible for delays or failures caused by events beyond our reasonable control, to the extent permitted by law.

These may include natural disasters, widespread internet outages, significant technical disruptions, government restrictions or other extraordinary events.

Where possible, we will take reasonable steps to minimise disruption and communicate any important changes.

Your rights under applicable consumer laws will continue to apply.

25. Electronic Agreements

You may be asked to accept these Terms electronically when purchasing or enrolling in a programme.

Where permitted by law, electronic acceptance may form a binding agreement.

We may also provide purchase confirmations, notices and other documents electronically.

Please keep a copy of these Terms and your purchase confirmation for your records.

26. Entire Agreement

These Terms, together with any applicable programme-specific terms and policies, form the agreement between you and Overcome PMOS Naturally concerning your purchase and use of our services.

If there is an inconsistency between these Terms and specific written conditions provided for a programme, the programme-specific conditions will apply to that programme to the extent permitted by law.
